Real Estate Waiver, Release and Hold Harmless Agreement

Pursuant to a contract of sale with the Seller or Real Estate Agent, I the Seller or Real Estate Agent, have hired ListPix Studios to prepare the media for the sale of my property. I, the Owner, represent, covenant and agree, on behalf of my heirs, assigns, and any other person claiming by, under or through me, as follows:

1. I acknowledge that the client may enlist the services of other professionals for marketing and promotion of the Property, including but not limited to photographers. I acknowledge the photograph(s) taken of my property will be uploaded to the MLS listing service and that these photographs may end up on other third party websites, like Zillow and Trulia solely for promotion (the “Activity”). I acknowledge the Photographer does not have control in how the photographs are used online or on the MLS listing service for marketing and promotion. I accept and voluntarily incur all risks of any injury, damages, or harm which may arise as a result of engaging in this Activity regardless of whether or not caused in whole or in part by the negligence or fault of Photographer (the Released Party”).
2. I waive any and all claims for losses, damages, or claims, whether known or unknown, which may arise during or as a result of engaging in this Activity, regardless of whether or not caused in whole or in part by the negligence or fault of Photographer.
3. I agree to indemnify and hold the Released Party harmless from all losses, liabilities, damages, costs or expenses (including but not limited to reasonable attorney’s fees and other litigation costs and expenses) incurred by any of the Released Parties as a result of any claims or suits that I (or anyone claiming by, under or through me may bring against the Release Party to recover any losses, liabilities, costs, damages, or expenses which arise during or result from my participation in the Activity, regardless of whether or not caused in whole or in part by the negligence or fault of the Released Party.
4. I have carefully read and review this Waiver, Release and Hold Harmless Agreement. I understand it fully and I execute it voluntarily.
